Up to which generation can Italian citizenship be passed down?
According to Law 74/2025, Italian citizenship can be transmitted up to the second generation, as long as all legal requirements are met.
For those who do not qualify within this limit, it is possible to apply for recognition through the judicial process.
Can I apply for citizenship from my country of origin, or do I have to travel to Italy?
There are several ways to obtain Italian citizenship — administratively, judicially, or through recognition in Italy.

What if I can’t find a birth or marriage record?

How can my children acquire Italian citizenship?
Under Law 74/2025, Italian citizenship is no longer automatically transmitted to minor children born abroad.
To recognize it, parents must:
• Submit a formal declaration at the Italian Consulate within one year of birth.
• Ensure that at least one parent held Italian citizenship at the time of birth.
• Pay an administrative fee of €250 per child.
In most cases, both parents must sign the declaration (or one parent in the event of death or legal guardianship).
Exception: If either parent was already an Italian citizen and had lived at least two years in Italy before the child’s birth, the child may be automatically recognized as Italian.
Children born up to March 27, 2025, remain eligible, provided the declaration is submitted before May 31, 2026.
Can my spouse obtain Italian citizenship?
Yes. If you are married to an Italian citizen, you can apply for citizenship by marriage after:
• 2 years of legal residence in Italy, or
• 3 years of marriage if living abroad (18 months if you have minor children in common).
Required documents include a marriage certificate, criminal record certificate, Italian language exam (level B1), and submission of the application to the Consulate or the Ministry of the Interior.
How long does the process take?
It depends on the type of procedure. In Italy, the process is usually faster, while judicial cases may take longer.
What matters most is having a clear plan and a solid strategy to ensure each step moves forward without unnecessary delays.
Is citizenship the same as a passport?
No. Italian citizenship is the legal right to be recognized as an Italian citizen. It’s granted once and does not expire.
The Italian passport, on the other hand, is a travel document you can request once your citizenship has been recognized. It has an expiration date and must be renewed periodically, like any other passport.
